    Welcome to TCI Mobile Concierge (the "App"), a mobile concierge service operated by TCI Mobile Concierge ("we," "us," or "our"), a company registered in the Turks and Caicos Islands ("TCI").
    Please read these Terms and Conditions ("Terms") carefully before using our mobile application and concierge services. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

    1.   Scope of Services
     
    Service Provider: The App acts as an intermediary marketplace connecting users ("Clients") with local third-party vendors, tour operators, transport providers, and hospitality professionals ("Service Providers") in the Turks and Caicos Islands.

    Booking Platform:
    We facilitate reservations,

    • Excursions

    • Villa provisioning

    • Transport

    • Custom requests.

    Independent Contractors: We do not directly own, manage, or operate third-party excursions, transport vehicles, or rental properties.

    2.   Eligibility and Account Registration
     
    Age Requirement:
    You must be at least 18 years old to create an account and book services.

    Account Security:
    You are responsible for safeguarding your login credentials and for all activities that occur under your account.

    Accuracy of Information:
    You agree to provide accurate, current, and complete information during registration and booking.

    3.   Payments, Fees, and Currency
     
    Currency:

    • All prices

    • fees

    • transactions displayed in the App are in United States Dollars (USD)

    • the official currency of the Turks and Caicos Islands.

    Taxes and Fees:

    Prices are subject to applicable TCI Government taxes, including the standard Tourism Regulation Authority tax and Value Added Tax (VAT) where applicable.

    Service Fees:

    We reserve the right to charge a convenience or service fee for facilitating bookings, which will be disclosed prior to checkout.
    Payment Processing: Payments are securely processed through our designated third-party payment gateway. You authorize us to charge your chosen payment method for all bookings made through your account.

    4.   Cancellations and Refunds
     
    Vendor Policies:

    Cancellations and refunds are strictly governed by the specific policies of the individual Service Provider (e.g., boat charter, restaurant, spa) booked through the App.

    Weather Cancellations:

    For marine and outdoor activities, weather-related cancellations are determined solely by the Service Provider or the TCI Coast Guard. If a tour is cancelled due to weather, a reschedule or refund will be issued according to the vendor's policy.

    App Fees:

    Our administrative service fees are non-refundable unless a booking is cancelled entirely by us or the Service Provider fails to deliver the service.

    5.   User Conduct and Responsibilities
     
    Local Laws:

    Users must comply with all local laws and regulations of the Turks and Caicos Islands, including but not limited to environmental protection laws (e.g., National Parks regulations, prohibition of taking coral or marine life).
    Illegal Activity: The App must not be used to request, arrange, or facilitate any illegal services, including illicit drug procurement or unauthorized transport.

    6.   Limitation of Liability
     
    Third-Party Fault:

    We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any third-party Service Providers, nor for any personal injuries, death, property damage, or other damages resulting from their services.

    App Downtime:

    We do not guarantee uninterrupted, secure, or error-free operation of the App. The service is provided on an "as-is" and "as-available" basis.

    7.   Intellectual Property
     
    Ownership:

    All content, logos, graphics, software, and user interface design within the App are the exclusive property of [Insert Company Name] and are protected by local and international intellectual property laws.

    8.   Governing Law and Jurisdiction
     
    TCI Jurisdiction: These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the Turks and Caicos Islands.
    Dispute Resolution: Any legal action, dispute, or proceeding arising out of or relating to these Terms or the use of the App shall be brought exclusively before the courts of the Turks and Caicos Islands.

    9.   Amendments to Terms
     
    Modifications: We reserve the right to modify these Terms at any time. Updated versions will be posted within the App with an updated "Last Updated" date. Continued use of the App following changes constitutes acceptance of the new Terms.
